1. Introduction

Welcome to MotionCraft. By accessing or using motioncraft.art and our related AI video generation services (collectively, the "Service"), you agree to be bound by these Terms of Service ("Terms"). Please read these Terms carefully before using the Service. If you do not agree, do not use the Service.

2. Service Description

MotionCraft provides AI-powered text-to-video, image-to-video, and related creative tools. Some features may be available without signing in, while others may require an account, subscription, credits, or payment. The Service may integrate third-party AI models, payments, storage, and infrastructure. Unless explicitly stated otherwise, MotionCraft is not affiliated with or endorsed by the underlying third-party model providers.

3. Accounts and User Obligations

When using the Service, you agree to:

• Provide accurate and complete information and protect your account and login credentials.
• Accept responsibility for activity under your account and promptly report unauthorized use.
• Comply with applicable laws, regulations, these Terms, and platform rules.
• Not circumvent credit, rate, content, security, or other technical limits.
• Not disrupt or gain unauthorized access to the Service, servers, networks, or other accounts.
• Upload and use only prompts, images, videos, audio, and other material you have the right to process.

4. Intellectual Property and Generated Content

You retain the rights you hold in content you upload. You grant MotionCraft a limited, non-exclusive license to host, copy, transmit, process, and display that content only as needed to provide, protect, troubleshoot, and improve the Service.

Subject to these Terms and payment of applicable fees, you may use generated outputs for lawful personal or commercial purposes, subject to applicable law, the terms of relevant AI models or third-party services, and any product-specific restrictions we disclose. AI outputs may resemble content generated for others and may not qualify for copyright or other proprietary protection. You are responsible for reviewing outputs before use or publication and for ensuring that your inputs and outputs do not infringe third-party rights.

5. Privacy and Data Protection

Our privacy practices are described in our Privacy Policy. To provide generation, account, history, subscription, billing, support, security, and analytics features, we may process account information, prompts, uploaded source material, generated outputs, task records, transaction information, and technical data. By using the Service, you acknowledge that you have read our Privacy Policy.

6. Subscriptions, Credits, Billing, and Cancellation

If you purchase a subscription, credit pack, or other paid feature, the applicable price, billing period, credit amount, expiration, and product entitlements will be shown on the pricing or checkout page. Credits are not bank deposits, securities, or cash equivalents. They are non-transferable and may not be redeemed for cash except where required by law.

Subscriptions may renew automatically for the billing period shown at checkout until cancelled. You can manage or cancel a subscription through the customer portal made available by MotionCraft. Cancellation generally stops future renewals but does not retroactively cancel benefits already provided during the current billing period. Refunds are governed by our Refund Policy and applicable law.

7. Acceptable Use and Prohibited Content

You may not use the Service to generate, upload, process, or distribute:

• Illegal, fraudulent, deceptive, or unlawfully facilitating content.
• Child sexual abuse material or content that sexualizes, exploits, or harms minors.
• Non-consensual explicit content, intimate imagery, or sexualized deepfakes.
• Hateful, harassing, threatening, abusive, or violence-inciting content.
• Content that infringes intellectual property, privacy, publicity, or other third-party rights.
• Content that impersonates another person or uses a real person's likeness or voice in a deceptive, harmful, or confusing way.
• Malware, spam, or material intended to bypass, probe, or damage security measures.

We may refuse to process, block, or remove content, restrict or suspend accounts, and preserve or disclose related information where required by law. You remain responsible for content you create, publish, or distribute using the Service.

8. Refunds and Support

Except as required by applicable law or stated in our Refund Policy, purchases of digital services, subscriptions, and used credits are generally non-refundable. If a generation task fails because of a confirmed platform or provider error, the associated credits may be automatically released or returned. 9. Service Availability and Changes

We work to keep the Service available, but we do not guarantee uninterrupted or error-free access or that every feature will remain available. Third-party AI models and infrastructure may cause delays, failures, capacity limits, or output differences. We may modify, suspend, or discontinue any part of the Service for maintenance, security, legal, business, or technical reasons, with notice where reasonably practicable.

10. Disclaimer of Warranties

To the maximum extent permitted by applicable law, the Service and all outputs are provided "AS IS" and "AS AVAILABLE," without warranties of any kind, express, implied, or statutory. We do not warrant that outputs will be accurate, original, non-infringing, fit for a particular purpose, or meet your expectations. You should conduct human review and any necessary professional assessment before relying on, publishing, or commercially using an output.

11. Limitation of Liability

To the maximum extent permitted by applicable law, MotionCraft and its affiliates, service providers, and suppliers will not be liable for indirect, incidental, special, consequential, exemplary, or punitive damages, or for loss of profits, revenue, goodwill, opportunities, content, or data arising from use of or inability to use the Service. Nothing in these Terms excludes or limits liability that cannot lawfully be excluded or limited.

12. Suspension and Termination

We may restrict, suspend, or terminate access if we reasonably believe you violated these Terms, created a risk to users or the Service, failed to pay amounts due, or if the law requires us to act. You may stop using the Service and cancel subscriptions through the available account or customer portal. Provisions that by their nature should survive, including intellectual property, disclaimers, liability limits, and dispute-related terms, remain effective after termination.

13. Changes to These Terms

We may update these Terms from time to time. We will post the updated Terms on this page and revise the "Last updated" date. If a change materially affects your rights or obligations, we will provide notice through the Service, by email, or by another appropriate method where required by law. Continued use after the updated Terms take effect constitutes acceptance of them.
